What is the process and how difficult is to buy a house in Bankruptcy 7?

Profile picture for flerz
There's a house we looked at that we really like, the the house is being sold because the owners are going through bankruptcy.

What is the process to buy a house through bankruptcy court?

How hard is it?

It depends on Chapter 7 or 13. If the owners are willing(the sale maybe not what they really want) to sell it the best thing is to contact them and have them speak to their attorney. If they are going thru a 13 they may want to try and keep the house and if their income is enough they maybe able to.If the property is already listed they may already have court approval, with that they would need a viable contract within what the appraisal/BPO was valued at.

I closed one and all it took was 1 additional week due to the Courts being on Vacation and the release having not been signed.
Find yourself a good Realtor in your area, they can get more info from the listing agent.

Very difficult. If you can find out who the Executor is, you can sometimes approach them directly with an offer.
You could ask a local agent to see what they can find out. They may or may not be willing to spend the time doing so; they may or may not be able to get more information.
You can also try registering with the local auction houses so that you would be alerted if the house went to auction.

I have heard from others that it is difficult, but I do not know that for sure. You might ask a local agent in your area if they have dealt with this situation before. They may be able to give you more information.
