What to do if mortgage company won't give me a GFE and many other things

I have been waiting to close on a property for nearly 2 months. I am paying in full with cash and it was a foreclosed property and the banks said the freeze has been lifted. They have changed my closing date for 2 months. Also the bank that has it listed said I am not owed a GFE because I am a cash buyer.  I am supposed to close Dec 28 but who knows. Could they be playing the run around so I back out and they can relist it for a higher selling price? Lots of questions. I just don't know what to do. Any advise?

Your attorney/escrow agent should be able to provide you exact fees for your closing.  It sounds like you are not represented by a buyers agent?  If so, your only recourse is to contact the selling (listing) agent for an explanation of the delays.  Best of luck!

Jes is correct that you don't need a GFE since you are a cash buyer.  However, you should get an estimated HUD before signing closing documents that show what closing costs you are responsible for (i.e., escrow fees, recording charges, etc. that are customary for buyers in your area).  Are you being represented by a real estate agent?  If yes, you should have your agent find out why the closing is being pushed out.

SamJay,

By law your lender must give you a GFE, since you are paying cash you don't need one.  The GFE is good to track third party fees and terms of your loan. The beneficiary of the property doesn't have to give you a GFE.   If you are in escrow, they just can't can cancel the escrow.  All parties have to agree.  Best bet is to talk to your agent and the listing agent.  Or talk to a real estate attorney.
