Well you're speaking in hypothetical terms, but if you have a situation where a listing agent appears to not be conveying your offer to the seller and it's a residential property still occupied by the seller then why complicate things? Just knock on the door of the home and hand your offer to the seller. There are certain, specific circumstances where the listing agent may be required to pass the offer along to the seller, but again, why complicate things, you're not a party to any agreement regarding the seller and the listing agent.

Call his office and ask to talk to his broker. The broker is responsible for all agents and ultimately carries the liability for ALL customers.

If you're represented by an Agent/Broker then you shouldn't be the one attempting to follow-up on an offer. Your Representative should be contacting that persons managing broker. The Listing Agent/Broker in many states cannot legally discuss your offer with you directly and must go through the Selling Agent/Broker representing you.

Thank you for the information. We have made arrangements to send the written offer however the agent representing us indicated that he's had issue with the listing agent previously. He's holds the belief that the agent lists properties as required by law but holds them for 'wholesale'?

You need to deliver a written offer. Listing agents do not respond to verbal offers as they are not an offer if they are not in writing. If they are not responding to a verbal offer give a deadline on the offer. If they do not respond then your agent should get their broker to contact the other agents broker to get the ball rolling.

Contact their broker in charge if they don't represent their client by answering the phone.
