Why does HARP consider Maintenance payments an expense?

If the Maintenance payment I make (divorced last year) is subtracted from my gross income I would meet the 31% rule but because it is later in the calculation I do not. Maintenance is a direct subtraction of gross income on our taxes but the HARP program considers it and 'expense'. Is there something I can do with this and qualify for a HARP loan or modification?

Correct, but for a modification, he would need to show hardship and that his current PITI is above 31%.

I'm not aware of any loan program that does not consider alimony or child support an expense.  For the purposes of a loan, it's treated just like any regular debt payment.
