Why would a seller ask for an "as is" agreement to be signed after the inspection?

We've put an offer on a house and the seller asked that we sign an "as is" agreement. We said no, they then asked if we would sign the agreement after we had an inspection. Why would they ask for the agreement to be signed after the inspection?

A seller can be responsible for latent (hidden) defects that they knew about, or should have known about.  These can be defects that are discovered long after the property is sold.  So, they either know of a defect and are attempting to release themselves from liability, or they are being very cautious.  By signing an "as-is" agreement, you are giving up certain contractual rights and remedies.  I would ask for a concession in return.  However, as another poster said, for most banks, auctions, and other distressed sales, an "as-is" clause is normal.

What did your real estate agent / buyer's agent say? Have your agent go over the contract with you, particularly the clauses pertaining to inspections, Inspection Notice, and Resolution of Unacceptable Conditions. Most states no longer include "as is" clauses in their standardized contracts. Banks and some other corporate type entities do, though. Again, refer back to the contract with your agent. They can explain to you how much time you have to submit your resolution requesting the seller to repair or remediate whatever was found on the inspection reports that you cannot live with. After inspections, the buyer has the right to move forward, ask for repairs or a price adjustment, or cancel the contract according to the terms of the contract. The seller has the right to agree to some or all of what the buyer requests or to cancel the contract. All parties must come to agreement to move forward BUT there are deadlines so talk to your agent right away.

I always ask them, Denver. We could come up with a bunch of reasons, but the important thing to know is: why would the Seller ask for it?

You will have the opportunity to object to certain inspection items whether that be repairs or money you are looking for. If you. Ant come to an agreement then you either take the property as it is or terminate. By coming to an agreement on the Inspection Resolution, you are already agreeing to take the property as is, except for anything you've already laid out on the resolution. It is your brokers duty to explain this to you and if you don't have one, then it's the listing brokers duty (if they are a transaction broker)

Unless otherwise stated ... YOU ARE BUYING IT AS IS!

You can certainly do your home inspections and kick the tires for a few days, you can certainly make request for concession if you found anything wrong or unsatisfactory upon home inspection (and the seller can simply say "NO") you have the right to walk away if your unsatisfied after home inspection as well.

But you ARE indeed buying as-is.

They are requesting this, because they don't intend to pay for any repairs.  They are allowing an inspection for your peace of mind, and to let you back out of the transaction entirely, if you choose to.   However, they are making it clear that they will not pay for any repairs prior to closing.
