Zoning and setback question. House over line.

We recently had a survey of our property for a building permit. And found out that the 32 year home we own is over the front setback line by about 1'. The front setback is 30' and we are currently at about 29' The house builder did this. It was permitted work. I know we can apply for a variance. Just wondering if this is a big or small problem? How should we proceed to get this fixed. We also don't want to open any cans of worms with the city officials. Should we lay low as far as trying to get permit for the unrelated improvements. Don't want to red flag until we figure this out. The contractor says don't worry, the city won't care about the 29'. That they are just concerned with the proposed work?
