bank stalls; rates rise
I applied to refinance my mortgage before Christmas; just to keep it simple I applied with my current mortgage holder (megabank, rhymes with __ittybank). I got a lock until Jan 22 on a 4.75 rate (in exchange for 1.75 poiints), and was charged $525 application fee. I sent in all the paperwork, got appraised; of course, Jan 22 came and went with no action from them. At this point I can't get anyone on the phone to discuss what's happening; I get referred from one "assistant" to another until finally I end up in voicemail, whereupon I leave a message that doesn't get answered. I didn't chase another lender since these guys had my deposit; of course, now the rates have risen. Do I have any recourse to enforce the original lock? Thanks.
