Dear mtupaso, You can sell the property to anyone you want. As far as if you would have any legal problems with the IRS, you need to sit down with an accountant and/or a lawyer to review the details of your situation and advise you. Good luck! If your former spouse is on the deed, you can still deed her your interest in the property.

What are the tax consequences is really the question you are asking.  That's going to take more facts than you gave and someone with expertise in tax.  You probably don't want to just go with the advice you get on a forum.

The IRS Publication 523 might be helpful. It has information on tax consequences for selling in special situations and gives the the exclusion amounts for primary residences. Hope the link helps.

Hello mtupaso,


Sure, you can sell your house to whomever you like.  Whether the IRS has problems with it or not depends on whether you have problems with the IRS today.  Another factor is whether or not the former Mrs. mtupaso is on the deed of the home already-- if she is, you can't sell it to her because she already owns it. 

If you have a specific issue with the IRS than the best person to speak with will be a Real Estate Attorney or an accountant.
