can seller's agent negotiate another offer while the hosue is in Active Option period?

After the home inspection, the cost of repair is about 2,300. But the seller refuses to repair or give some allowance. The seller's agent told me agent that there is other offer is higher than mine, so the seller hopes I terminate the contract. Can the seller's agent negotiate another offer while the hosue is in Active Option period?

Yes, the seller can consider other offers and negotiate and accept a back up contract. The sellers agent may not disclose anything in the other offer without the seller's permission. Perhaps the other offer is higher - or maybe they're just bluffing.

Either way, you are the only party the position to make the purchasing decision at this point (while you are in the option period). If you don't like the terms, walk away. If you want the house, you may have to forget about the $2300 in repairs.

As long as the listing has not gone to closing the seller can review offers. Which does not mean he can promise to sell it to someone else someone else.Right now the seller is obligated to you and only you to sell you his home. Unless you want to terminate your contract.
Sometimes the deal falls apart at the closing table.....and if it does the seller has something to fall back on (the other offer he is considering).
Are you positive the other offer is higher? Who ever let this slip out violated their fiduciary duty.....

Read your paperwork and talk to a local Broker or Attorney to advise you on Texas Laws, rules, loop-holes&such.

If you really like the property, are you willing to pass on it for the sake of $2300.00?

If it is priced so close to the high end, $2300.00 is just simply too much more to ask, and the seller won't budge, find your legal way out.

As for the higher offer, it might be higher but that does not mean it is BETTER.

I am sure you know how to play poker being in Texas.

Follow these simple instructions to stack the deck in your favor.

A lawsuit will cost them more than $2500 in legal fees alone.
--  they should consider that if they can think they can break an contract.

Undo influence.. more like the seller doesnt want to fork over a nickle and maximize profits at your expense.

While I am not familiar with Texas law, most often there is an 'inspection contingency' as part of the purchase agreement. This is a time sensitive device. If you have a inspection contingency and you have requested the seller to either do repairs or lower the contract price and they have refused, essentially your contract is dead in the water.

Depending on the language of the purchase agreement, the seller may or may not be able to continue to show the property while the property is in the inspection phase. (dependent what box is checked on the purchase agreement). However the agent is required to tell other agents that the property is sold pending inspection.

If you  feel the property is not worth the money, sign a termination of the purchase agreement and let some other sucker pay too much.

Yes,
They can negotiate another offer as a back up. Then if you back out they will take the new offer.
I always have my clients make their best offer.  I tell them about these situations, because they do come up.
I make sure they feel comfortable with the price just incase the seller does not want to do any repairs or another offer comes in and trys to trump us.
Just my opinion.
J.
