cancelling short sale

Went to cotract in June. It's now Dec..Almost went to closing,but pool has been damaged.Also owners were told they had to leave by bank even though there was no date for closing. The owners left but didn't take their cat. Asking to see house the realtor would not let us in for 2 weeks. Finnally we got in. The house was clean, but still smelled of cat. The electric is off, therefore no heat and no one is maintaining the house. We want to cancel the premises is no longer as is.Can I get out of this? Will I lose deposit? They have threaten to sue for broker fees & hafa relocation fees. can they due this? The home is in NY

If you have a real estate attorney, I would listen to what he has to say.  Oftentimes its confusing to listen to too many opinions, primarily ours, because we have not seen your contract..

I have a lawyer, he has the contract, We were supposed to close by 9/29 according to the lender. I was told that it could be extended. The short sale agreement expired so did the appraisel. The home was  found on MLS and we called the broker showing the home. This is a holiday week, so I haven't heard anything.

What does your agreement say?  There are typically time-frames for the length of the process and ways in which to terminate the agreement if those time-frames aren't met.
I just hope you aren't going to tell us that you used the listing agent to represent you in this offer to purchase.

Without knowing what your contract says, it is difficult to know.  I suggest you discuss this issue with your buyer agent or the agency broker.  If you do not have a buyer agent, then you may need to seek counsel.
