After months of searching for the perfect house, I stumbled upon one I absolutely adore. Unfortunately, the house (which is being sold by owner) has had a recent (less than 7 years) suicide in it. The owner denies claims, but after speaking to several neighbors, I am assuming it is so. Must a seller disclose such information? Why would seller deny it if they could get in possible trouble? (lawsuit)

It depends on your state. In Arizona it is not required by law. However it should be disclosed as it is a material fact. BUT if you ask the seller if a death has occured on the property and she denies it, and a death actually did occur, she is in violation. To not be in violation she needs to either be truthful or tell the person asking that she is not required by law to diclose that fact. In California I believe there is a 3 year statue of limitations, so that it has to be disclosed if it happened within the last 3 years.

How is the fact that a death occurred in the house, material (important) to the house?

It has no structural bearing. Nothing is wrong with the house... just a former owner was "ill", and it's not contagious... so I don't see how I'm responsible (in any state) for disclosing that.

However, if asked directly, and a death DID occur in the house... I also don't see any reason to deny it.

396, it's actually a question on one of the seller's disclosures. There are a lot of people who don't want to live in a house where a death has occured, especially a murder or suicide.

Marci is right, thats why it is seen as a material fact to some. Some people just don't want to live in a house thinking about that this is where that person died. And I am sure some people think there can be negative energy in the house if there was a murder or suicide.

In my neck of the woods where homes can be up to nearly 4 centuries old, one just expects that there have been deaths...including murders and suicides.

And everyone knows if you encounter an annoying ghost, you tell them to go toward the light ;)

There are a couple of houses in my area that sat forever because one was a suicide and one was a murder-suicide. Even at really low prices, those houses wouldn't sell. It's a CA thing I suppose. :)

Come on, what's wrong if somone dies in a house? Back in the old days, people would die at home as opposed to the the hospital so just about every other older home you look at will have had a death occur in it.

Here in NJ, a large hospital was recently converted into condos. Just think of how many deaths occurred there! And yet, it did not stop someone from buying the penthouse unit for $2.3 million.

but what about the person who kills them self and whole family in their sleep. a really troubled death in the house.

if I did not know about a crime in the house I would be ok but tell me some one died a horrible death in a house where I wake u in the middle of the night to get a drink of water or walk through a dark house...scary.

exactly walty. Most people aren't bothered if someone dies peacefully in their sleep from natural causes. I know I wouldn't want to live in a house that had someone died a horrible death in it.

Dear Ziggy, if you are in love with the house otherwise, buy it. It's not the house's fault that somebody inside gave up -- whether for medical, financial, emotional or other reasons. Many more people kill themselves than we realize by the statistics.

A dear friend of mine bought a home in which a husband found his cheating wife one Christmas Eve, and killed her, the lover, himself, and all four of their children in a true basement blood bath. The house was just fine and (especially after that ghastly experience) seemed quite grateful for its new owners' children -- all of whom grew up to attend college and play football like champions. It was a beautiful home....and nothing it did or failed to do caused the wife to cheat or the husband to go nuts about it.

In New York State, the seller does not need to disclose a suicide. There is a 1995 amendment to he New York State Property Law (Section 443-A) which states that an owner or tenant or agent does not to disclose to a potential buyer that the property was the scene of a homicide, suicide or other death or a felony. Also, if the property was ever owned by someone who was HIV-infected or who had AIDS or any other disease that was not transmitted through the property will not be disclosed either.

I would want a home with a death in it. Its like lightning, not likely to happen again. Also you could pretend it disturbs you to negotiate, but in this market who needs to pretend to negotiate? However, if I were superstitious, then I guess I would be scared.
