eletronic signing

How many of you have used electronic signing for your purchase contracts and all documentation needed to close a sale of a home, whether representing a buyer or seller? We are having great success in our office, all our agents are E -Sign Certified.

" e sign certified" ???

what the heck is that? I bought docusign, it took 2 minutes to figure out how to use it...

I think i will get "walk and chew gum at the same time" certified...

I know little about this system and I have some questions if you don't mind. What safeguards do you have in place to assure that the stated seller/buyer signing electronically are who they say they are? Do you have some have one trained to inspect identity documents in your office to prevent fraud. And do you have an electronic date/time stamp to prove when offers were submitted, received, signed or returned built into that system?

good questions. The e sign has an email verfication, and I believe records IP addresses, along with date/time of signature.

But ask yourself this question: what verfication/proof do you have a regular signature? After a couple of times through the fax, how well can you determine who signed something? The real estate form and addendums can end up with dozens of signatures, what if somebody changes something in mid page AFTER you sign it, and then faxes it [happens, believe it or not] with e-sign, you have the times of all alterations, and the times of all signatures, which cleans the process up a ton.

Thank you for the info! I really hadn't heard much about e signing. I hoped that it would be useful in speeding up transactions by transferring docs electronically while hopefully not increasing fraud. You are definitely right about those faxed signatures though. After a couple passes back and forth anyone could have signed them.

You all pose very good questions. The e signing through settleware gives us the capacity to e sign all documents, not just winforms. We can e sign, escrow documents (we do this with Central Escrow and Discovery Escrow all the time) disclosures, contractor bids etc., demands etc. We have a universal license and we have all sorts of bells and whistles that docusign does not have. I have an electronic vault which is tamper resistant and fraud proof. Which is excellent back up and storage for my files, in addition to having it on our server and local computer.
As far as identity verification it's as secure as your ATM card. If you give your PIN to everyone, well everyone is going to pull money out of your account if you have any! This too has a PIN and it records the IP address, time and document number. Fannie Mae, Freddie Mac and all 50 county recorders offices have approved it and it has been used since 2000! It's awesome!
Did I mention I pay a flat fee, no matter how many documents how many signatures. I love my universal license. Oh did I mention I have a electronic data transfer included, I can send support documents (i.e. REO's,Probates, Trust and Shortsales) and send it in a secure environment which will be sent to the other party as a link. It NEVER GETS stuck in a spam folder. NO software to download every.
Yes it is the cats MEOW!
And since we have so many things we can do with E signing through Settleware, you do need to become e sign certified.
Why Use a Yugo when you could be driving a 500 SEL Mercedes?

Perhaps there should be  a way to get rid of signatures.  Or reduce the amount of signatures.  That would be nice.

Has anyone done any research on number of signatures that are usually required through out the purchase/selling phase?

There has to be a simple and better way.
