It is easy to assume the worst if you have a reason to believe your land lord may not be paying the mortgage.
The problem is the information that is out there and being told to people for the most part is wrong.
Most people believe (have been told) the only way to get help on their mortgage is if the stop paying it.
This leaves homeowners in a very bad situation. Some go to the wrong source for help, some wait until right before the sale to get help.
However if the home does get foreclosed the tenant may be able to stay and fulfill their lease however you have to be current on your payments with the landlord.
You can find out from a local title company or pull the records from the online website at the county recorders office.

Check with the county sheriff's office to see if they have a record of foreclosure proceedings.

In California once the NOD has been filed it is public record. You can go to your county office or you can most likely have a RE agent to look it up for you as many have access to that information. The problem is that when the NOD is filed you are well into the foreclosure process and may only have about 3 1/2 months after that date.
I know it may not seem fair but you are still responsible for paying rent even if the landlord is not paying the mortgage. The landlord is still legally responsible for the property. The good thing is even if the property goes into foreclosure you will not be kicked out on the street. The new owner will have to honor your lease unless they intend to live in the property and even then you have a couple of months. Usually they will offer you a fair amount of money so you will go away and often times will not charge rent for a month or so either.
