The State of Hawaii is bound under all the federal laws as any other state in the United States.  As we are an escrow state and not an attorney deeded state, all of our transactions must pass through the bureau of conveyances.  Along with the bureau, most all transactions are "escrowed" with a licensed Escrow Co. who oversees the workings of Title Search and Title Insurance and works as an independent 3rd party to distribute any exchange of proceeds and payments. If you have a property that does not get a clear title, it will show through the escrow process.  Escrow will also state any exclusion of rights you may have.  It is a good system and may even go into our 2nd recording system of Land Court, which is very strict with chain of title matters.  And, your Realtor should be able to get an upfront estimate of your closing costs before you enter into a transaction.

Let me suggest getting with a local specialist there. If you don't have a REaltor, look to a proven professional who knows the costs associated with buying a home there. Since they sell in Hawaii, they will most certainly have the details on property rights and restrictions there. I would start with a Realtor who has a proven track record for sales there and someone who has lived on the island for a long time. It's a good place to start. You can find a Realtor here by searching for an agent. Buyers have found me the same way. thanks and good luck!
