For future reference, It is never too late to speak with an attorney.  You make a better decision when getting the facts from a reputable source.  Unarmed and uneducated is not a good place to be when it comes to foreclosures. Just by making a response can delay the foreclosure for a while

Your brother needs to find a real estate lawyer that deals with foreclosures and litigation. The lawyer can try to work things out with your brother and the bank.  The banks take lawyers more serious than if you or I just called.  Another option is selling it quickly--a regular sale or a short sale.  The courts will look at contracts and give time for them to be approved.  I know a good lawyer if you want to give me a call.  Good Luck.

The process of a foreclosure takes at least three weeks. Trustee attorney's are required by law to broadcast in the local newspaper for three consecutive weeks prior to a foreclosure. So, he would have had to see it in the newspaper (usually in the city section where they provide public notice [Williamson AM] for example) last week and will see it again this week. If you have a realtor that has access to foreclosure homes in that area you can contact that person as well.

Go to your County offices where you will be able to locate tax records and title information. The foreclosure process takes longer than 2 weeks. First the home should go to a trustee's sale at your county admin offices or the county courthouse. If it does not sell it will revert back to the lender.

Best of luck
