if it's a HUD but won't go FHA because private road...how did it become a HUD???

so if there is a property on a private road that has never shown to have a recorded HOA for road maint. and because of this you can't do a FHA laon for it...then how did it become a HUD house?  did the FHA rules change, do I misunderstand this rule? or did it just slip through in the past??
