is a contract legit if one signiture is missing?

i get the news that the seller signed my contract and they were waiting for him to sign one spot where he forgot. but then all of a sudden someone offered them a cash offer that they are going to take now...is this right?

For a contract to be valid, one needs an offer and acceptance.  You did not receive an acceptance, so no contract exits between you & the Seller.  Unfortunately, this does happen from time to time.  You were in what the market calls a "multiple bid situation."

To be enforceable, a real estate contract must possess signatures and initials by the parties, in all required areas of the purchase contract.

It hardly seems fair, but the seller is able to accept the cash offer, because all required signatures we not on the contract.

The source of funds is not really important. At the end of the day the NET and closing time is most important. Your financing will have the same effect as cash. Just as long as your lender will close quick .  What if the seller was offered "cash" , only to find out that the guy is trying to wholesale his property? This will take him/her 2 steps backwards because they have to find a buyer all over again.  These are assumptions,  please update your situation as it progresses.
