over to a month to month lease on verbal not from renter but by landlord

If you are the co-signer you will need to get the release in writing from the landlord. When a lease goes  to a month to month it is understood that all the initial terms of the lease convey.

You should be able to find your state landlord tenant handbook on line.

Maybe. If you are the cosigner, you need to contact the owner and tell them that you want off the contract and that you refuse to extend your term as cosigner for the new rental agreement. Get a release from the owner now to protect yourself from any problems down the line with deposits, damages or unpaid rent.

Better safe than sorry.
