u sure can, there are lots of detales though.  would u pay him in cash? do u need a mortgage? how much is the existing mortgage? Are there any back taxes? Are there any leins on the property?

Yes...if you can qualify for the mortgage payment you can take it over. I would contact a local attorney to assist you with the ins and outs there. Due to the decrease of home values, you might come out of it great since the values have fallen but it would depend on when you purchased it, how much equity you have in the home or whether he's thinking he will get anything out of it. I would suggest seeking legal counsel since these are really questions they need to assist you with. thanks

I would add that the law may be different in your state and you should check with a good lawyer.  Generally, here in California you can buy our your soon to be ex, but I wouldn't recommend doing it without counsel.

Yes, you can, but you need a freetrader agreement from him in advance so he doesnt have a claim to the home you buy. You will, of course, still need to qualify for the home. Hopefully your credit will be intact? Sorry to hear about this, I hope you come through it unscathed.
