In our area, zoning too. You might be able to rezone, if that is what you are hoping, go to the city and ask or have your Realtor do some research.

First the house has to be zoned as a two family. Each town will then have certain criteria as to what the home needs to have to qualify for a two family residential property. Best to check with your local building department for the details.

In New York State a certificate of occupancy was optional until 1936 after 1936 they were mandatory. To try to answer your question your home is what its legal description is which is then further verified by a document called a certificate of occupancy. You should be able to find your certificate of occupancy to at your local department of buildings or town registries. I hope this helps

In my area, sprinklers are not required, nor even fire walls between units.

But the Zoning is critical.  Also proper exits for each unit (not through the other unit).
