what qualifies you for the $8000 tx credit, being off the deed or mortgage or both?

attempting to purchase a home and would like to know if i qualify for the 8000 tax credit.  My divorce become final in 2007 jan 2.  Howeve, He had to take me off the house prior to that.So my question is:  How can I be sure I qualify for the 3yr requirement?

My understand is that you can't have owned a house for 3 years prior to your purchase.  The normal definition of "owning" a house is being on the deed.  I would check with your tax preparer to make sure that you do qualify.
