When we first applied they used my credit history and my husband job history to get a a loan right before the arm was going to adjust we refi but this tiime they said I was to be taken off the loan and my husband and they used the equity to clean up my husband credit and then gave him the loan not only did I get screwed but now the house isnt even in my name is this fair ?

You are not screwed if the house depreciates and he has to foreclose. Only he is screwed. I wish my name wasn't on some loans right now. lol
 If you are worried about divorce, in many states it doesn't matter if only one spouse is on the deed. They are shared property states.

Yes as long as your name is still on title you are fine.  His income and credit was the only one to qualify on the current home.  If you are on title - then you still own the home - just not liable for the mortgage.

Is your name off the title as well as the loan?  If it is still on the title, you are fine.   If it was removed from the title (and you would have had to sign a document for this), then start pushing to get your name back on the title.
