Generally the Owner pays the Utilities unless the contract with the Builder says he pays for it.

Were the utilities in your name or the builders? If the contract stated temporary heat is paid by the builder, than that is who paid it. I wouldnt think an attorney would even need to get involved, maybe a threat of one. Sounds like the builder may not understand his own contract.

It sure sounds like the builder is on the line as he had the heat high for the drywal. Make sure in your weekly meeting with builder you turn the bill over to him.

Have you even talked to your builder about this? If you have a reputable builder and you have a written contract then they should pay without any problems. If however they don't pay up then you may need a lawyer.

You mentioned that the builder pays as described in the contract. What happened when you handed the builder the bill and said "this appears to have come to us by mistake?".
