Must seller disclose low appraisal to next buyer? http://www.zillow.com/advice-thread/Appraisal-low-contract-terminated-Must-seller-disclose-low-appraisal-to-next-buyer/422494/ Theoretical question here and just looking for feedback. Let's say a property is under contract for $200k. The appraisal comes in at $165k and buyer and seller don't renegotiate so deal terminates. Seller realists at $200k. Does the seller need to disclose appraisal information? Of course state law and prior legal rulings can be very different by state...but just looking for some opinions. However, we are appalled at the attitude of the sellers in this transaction! We first met them when they were leaving the house for the inspection, they were very rude, and didn't say hello or appear pleasant or polite. We (and the home inspector & our buyer's agent) had to wait 15 minutes, so that they could pack up their stuff and leave for 3 hours, so the inspection could be done.

They came back right at the 3 hour mark (even though they left late), and actually stood behind us, while we were discussing things with the inspector, literally shooing us out. The seller was rude throughout, and did not have any basic courtesy!

When the inspection report was submitted to them, neither their agent nor the sellers got back to us (our buyer's agent) within the 3 day deadline, and we are yet to hear from them about it. The fixes were minor, but we are not sure if we should negotiate the price or terms on the basis of the inspection. Our agent is advising that we can do the fixes ourselves, or we can also back out if we find another home that we like.

At this point, we are not sure if we should proceed with the purchase, even though we like the house. We are also annoyed at their couldn't-care-less attitude, and were also wondering if they can ruin anything in the house prior to closing, so we might have more fixing to do.

Any advice would be really appreciated!!

18 replies Fri, 03 Jul 2015 08:26:00 GMT http://www.zillow.com/advice-thread/Uncooperative-Sellers/593978/ 2015-07-03T08:26:00Z Can my seller's agent do double duty as my buyer's agent? http://www.zillow.com/advice-thread/Can-my-seller%27s-agent-do-double-duty-as-my-buyer%27s-agent/592761/ 13 replies Wed, 24 Jun 2015 21:02:00 GMT http://www.zillow.com/advice-thread/Can-my-seller%27s-agent-do-double-duty-as-my-buyer%27s-agent/592761/ 2015-06-24T21:02:00Z Please help me to understand. http://www.zillow.com/advice-thread/Please-help-me-to-understand/593587/ Zillow id#92822777 you est at $1,625,589, #113309154@1,483,400 and now as "coming soon" #2101872695 you est @ $837,395. The architecture style looks like town-home. I was getting a good interest rate with WF. When I got the preliminary report I came to know that it was a condo. Also in the title report land/use was mentioned as townhouse. So it confused me. later WF appraisal report came very low. We contested the appraisal quality with WF and the multiple levels of officials repeatedly told that it is a condominium and they will not consider the other property sales as comparable in that area because they are townhouse. So they stuck to the original low appraisal price. I placed the offer price listening to my agent and he/she told that other properties that got sold in that area, even though it is a townhome, will be considered as a comparable for the subject property. Isn't this misrepresentation? I tried other lenders suggested by my agent and they rejected my loan approval stating that I don't have good line of credit though my credit score is excellent. My deposit is on the line. Now listing agent is not ready to renegotiate the price. Technically even though the land use in the title report shows town-house, isn't this subject property a condo because in the prelims it shows as condo?Didn't the buying agent misrepresent the property in this case? Isn't it buying agent's responsibility to renegotiate the price with the seller instead of making me run-around looking for other lenders? I don't have enough financial resources to cover for the 100k. Also I can't go with PMI because already my monthly payment is really high. What is my way out without losing my high security deposit? Please advice

4 replies Sun, 05 Jul 2015 00:32:00 GMT http://www.zillow.com/advice-thread/appraisal-came-low-for-a-property-whose-land-use-is-condo-townhouse/594159/ 2015-07-05T00:32:00Z How do I list my home on Zillow? http://www.zillow.com/advice-thread/How-do-I-list-my-home-on-Zillow/594150/ 1 reply Sat, 04 Jul 2015 21:22:00 GMT http://www.zillow.com/advice-thread/How-do-I-list-my-home-on-Zillow/594150/ 2015-07-04T21:22:00Z How does Zillows estimate the value of a house http://www.zillow.com/advice-thread/How-does-Zillows-estimate-the-value-of-a-house/594144/ 1 reply Sat, 04 Jul 2015 20:29:00 GMT http://www.zillow.com/advice-thread/How-does-Zillows-estimate-the-value-of-a-house/594144/ 2015-07-04T20:29:00Z
