Question about the new extension's $800,000 limit

Recently I bought my first house in California, my purchase price is $810k.
My contract date is in October and my closing date is expected to be Nov 16th.

The previous tax refund policy has no house price limit and it applies to house purchase closed before Dec 1st 2009.

The new extended policy has a price limit of $800k, and the IRS form 5405 now says the old form (which doesn't have a limit on price) can only be used for purchase before Nov 7th.

So it seems I am qualified for the tax refund before, and suddenly because of this new extension, I'm not qulified for anything, not even a single dime? This is just unfair and even absurd.

Please let me know if my understanding is correct, and if there's anything I can do to claim my tax refund.

Declining Area

I was in the process of refinancing and got the denial because my property is in declining zone. Initially i was getting loan up to 80% on the loan amount of $1000000 however later on the said that they can refi only up to 70%. They say that my property is in declining area D. Where can i see that my property is in declining area or not? this concept of deducting 10% LTV is with all the lenders or it changes lender to lender??? which lender should i approach so that i can do my loan!!!!!

After doing research I'm more inclined to purchase home in Mission Place Rivermark Area -Residence 3 Plan. What would be the approx price in the current market?
Builder is quoting -- 639 ~ 649K

The elementary school, Eisenhower, is in the Cupertino School District.
