Mortgage Modification

I hired an attorney to do a mortgage modification. After 2 months he says that I don't qualify for any of the programs and the bank, BOA, won't let me do it. What else can I do? I want to stay in my condo. Can I do a "short sale" and sell it to my son, who has the same last name? If I do a short sale and my friend buys it can I buy it back immediately?

my arm will adjust in Nov 2010, I live on a fix income. I do not want to see my mortgage go up as the interest will surely rise. I want to sell and down size however the market is bad right now. I am putting additional $200 towards my prinicipal in hopes this will lesson the increase of interest when my arm adjust. Is this a good idea.
HELP PLEASE
