We were about to buy a house, but the seller took the house off the market for a while. Now he decided to sell. But in the meantime, my husband's boss asked him to switch from W2 (payroll) to self employment. My husband did so, he opened an S Corp this April (still working for the same company).&nbsp;He has been working in the construction industry for about 10 years now.&nbsp;<br/>Our credit scores are excellent and my husband's income increased.&nbsp;<br/>We are currently under contract, because our agent told us, we might be able to get the mortgage after we file the business 2014 tax returns (January). I have an accepted offer on a property. I like the property a good deal, and the inspection went fairly well (a couple of minor issues). After the inspection, I went to city hall&nbsp;to check on permits pulled (if any). In looking at the plot plan, I realized that the neigbor has encroached on the back of the lot by 2'. It ends up being a strip approx. 2' x 36.' The neighbor is using it as paved driveway and deck. Is this a walk-away/show-stopper type issue?&nbsp;I spoke to my mortgage attorney about it, and it clearly has to be dealt with before the closing. The attorney recommended just giving the property to the neighbor with an "easement in perpetuity." He noted that if liability arises from an action that occurs on the land (though it is a very small strip of land), we would be responsible -- if we didn't transfer liability through a perpetual easement. There's going to be additional legal fees, and it doesn't seem like the seller is amenable to assuming any additional cost. Does anyone have any advice on the best way to proceed?
