Who and Where to Sue?

Our attempt at buying a house fell through after some seriously shady actions by the seller or seller's agent. That's a story for a different time. Right now, we're trying to get our earnest money back from escrow and the seller is disputing our claim. The escrow agency won't disburse the funds without a court order, so it looks like Small Claims Court is only option.

There are a couple of parts of the filing that I'm not sure of but most of them can be boiled down to: who do I sue and where?

Do I sue the seller (a company)? The seller's realtor? The escrow agency? All three? If it's the company, then do I put the name of the guy who signed all of the papers?

Then, where is the claim filed? I was thinking that the location of the house in question made the most sense... but does it need to be the seller's address listed in the offer, instead?

home is at 3037 kessler ln gilbert Arizona. the aerial picture shows the corner house when in fact it is the house next door to the east.

how often do the aerial pictures change?

i EDITED THE HOME FACTS AND SAVED CHANGES ABOUT 20 TIMES AND IT NEVER TAKES. iT KEEPS ON STATING THE WRONG HOME FACTS ON THE HOUSE.

Sources for 6 month reserves on FHA loan

I am buying a new home but will not sell my current home until after the new home closes. That means that I will have two simultaneous mortgage payments for as long as it takes to sell my current home. That's okay from a debt-to-income ratio. It wouldn't be fun, but I can sustain both payments indefinitely.

In order to do this, though, my lender says that the FHA "buy and bail" guidelines require 6 months reserves to cover BOTH payments. That's more than a year's worth of my current payments (new home is more expensive). It's a very hefty chunk of cash.

But does it need to be cash? That's what my lender isn't clear on. What are the sources for the reserves? Can it be CDs? Stocks? Other?

Also, as far as the 6 months go, is that lender specific? I cannot find anything about that on any HUD or FHA site.
