Right now I'm leaning towards a 30 year fixed. Here is an overview of the situation any advice or ideas that anyone can give me would be greatly appreciated. The house I am currently living in was my grandparents and when they passed away the house was transferred into my aunts name. Due to some "sisterly fighting" there was a dispute over which one of my aunts should legally own the house. The court case ended in mediation with the following terms; Aunt 1 will remain the owner of the house until August of this year when I turn 22. At the time I turn 22 I "own" 75% of the property and my other aunt, Aunt 2, "owns" 25% of the house. Each one of us has the option to buy the other out of their share based on the fair market value and then that person must take over the house. <br/><br/>The problem with the situation is that due to the market falling we are now technically upside down on the existing loan even though there has been now problems with the payments being made. Unfortunately we have only come up with two possiblities for me to obtain a loan for the house. Option 1 would be for me to assume the existing loan, there is a clause that it is assumable, however that may pose a problem with the lender allowing me to assume an upside down loan. The new lender's underwriter keeps asking for a document titled as Note from Heloc issuer- Charter bank. Charter Bank- Citizens Bank- has a document, which has full details, called Credit Line Agreement. Charter Bank keeps saying that this Credit Line Agreement itself is the Note! The lender's underwrite wants to see with something like Note in the title!!! I am stuck!
