Seller relisted property possibly without disclosing defect and is having an open house this Sunday. My broker is no help. My lawyer recommends I do a 93a against seller and take him to court. I have lived there for nearly five years and only within the last month has my downstairs neighbor been REALLY nasty about noise (in fact, it's the only time he's ever mentioned hearing me). I have hardwood floors so after the first time he said something to me, I tried being more considerate: no shoes inside anymore, for instance. It seemed to placate him for a while, but then he started banging on his ceiling and yelling obscenities when I would watch TV at a reasonable volume and at a reasonable time. So, I started watching less TV and would read books or be on my laptop at night. This has helped and I haven't heard from him much since.<br/><br/>My question is, in Massachusetts, would this be something that I would need to disclose when I am selling my condo? I feel like the walls and floors/ceilings aren't properly sound proofed so you're going to hear things no matter what (but I also feel it's reasonable to expect to hear your neighbors in a condo). It just so happens the neighbor downstairs from me is very sensitive to it. I tried doing some research on MA laws, but some of them sound a little vague or are unclear to me. Whoever buys my place probably will not know to be super quiet (and nor should they have to be, in my opinion). <br/><br/>Of course it would be nice if I said something, but I really, really want to get rid of this place and I fear that a rude neighbor may hinder this.
