Closed with excessive ratios http://www.zillow.com/advice-thread/Second-HOA-not-disclosed-prior-to-closing-Closed-with-excessive-ratios/587645/ <p>Hi, we are hoping for some advice from those who might have come across a similar scenario.&nbsp;</p>We closed on a property in Florida on NYE and just received a bill for a quarterly HOA that was not disclosed prior to our closing.&nbsp; The seller only disclosed a monthly HOA. After researching, we were told by the HOA association that it is listed on our HUD. It is on the 3rd page and was not not brought up by the title company at closing, The HUD was also not available for review until we got to closing. Both our broker and lender were unaware of a second HOA and we would&nbsp; not have been approved with the 2nd. (ratios)<br/><br/>Our concern is we would not have bought the property if we knew the original HOAs were that high, Our broker, Lender, appraiser, and the MLS listing all include only the monthly HOA fee. The property was a Homepath property and sold as is. but our broker feels the seller should have disclosed the fees.&nbsp;<br/><br/>We are not sure what are options might be. I have no clue if these rules apply when my property is in an LLC?<br/><br/>For example, if there is no income from FMV rent, then usually you can't take any deductions for that time period other than the usual personal use itemized deductions. When you do have FMV renters, you can take a percentage of rental expenses and deduct those.&nbsp;<br/><br/>Do these types of rules apply when the property is in the LLC?
