Since the first of this year, I have seen 4 different representatives quoting in Georgia. The quotes always have 1 point discount and no origination fee. All 4 reps have basically the same notes to the borrower including:

NOTE: This quote is given with 1 percent loan discount charged to you. That equals 1 percent of the loan amount. If you wish to have a quote with NO discount points and only $555 of lender fees, please contact me for a personalized quote. The rate with no points is just slightly higher than the rate you were quoted.

Georgia homeowners are protected by GAFLA, Georgia Fair Lending Act, which includes the following language:
Bona fide discount points means discount points knowingly paid by the borrower for the express purpose of reducing, and which in fact do result in a bona fide reduction of the interest rate applicable to the home loan.

My question to your bank is do you feel you are exempt from GAFLA?
You must, unless you are doing loans just for the $515 lender fee.

GAFLA was designed to protect against predators but it also covers deceit.

32 replies Wed, 25 Feb 2009 13:12:00 GMT http://www.zillow.com/advice-thread/National-Bank-of-Kansas-City/203672/ 2009-02-25T13:12:00Z " New to Zillow " really? http://www.zillow.com/advice-thread/New-to-Zillow-really/357598/ Zillow, brokers and lenders that do not have a lender rating have a designation of "New to Zillow" on quotes submitted to borrowers. The 1st 2 lenders I looked at have been on Zillow for 2 years and both have over 5,000 quotes. In fact, 1 of them did have a 5/5 rating until you removed that rating because the review came from an employee. I am not talking about fees outside of the 800 section, or prepaids, but am talking about fees quoted in the 800 section and terms/rates. I just read the review below on a lender and it is important to leave a review like this, if this happens to you. The borrower is 100% correct in their assumption:

Zillow quote was 4.50% with .50 origination. The good faith estimate was 4.875% with 1% origination. Was told rates moved. Don't think they moved that much in 2 days. Sounds like bait and switch to me. BEWARE

Many of us see quotes everyday that can not be delivered and you should point this out if it happens to you. Also, be sure to READ the reviews as some lenders can have a green bar because of their overall average even while the last 4 reviews are horrible. But now I think it's about the negative remarks directed at James Wornast.

Yesterday ZMM closed a tread to responses. Today they closed a thread and moved it. The only time in the past were this was done was when the thread was not on topic.

On top of this, Lindsey lost her badge yesterday for standing up for her ligitimate USDA quote.

Is James that influential? Does ZMM want to lose the "regulars" on Mortgage Advice? I stopped manual quoting and I will not go the API route. I won't quote BS to make my phone ring.

Many "regulars" feel the same. If the "regulars" cannot speak their honest opinions without getting "slapped," why contribute your time when it's not appreciated? .....
