Legacy Real Estate Associates, Fremont CA- Review

I was in the process of buying a house whose listing agent was Sherri Stoneberger with Legacy Real Estate, Fremont, CA. She is the most unprofessional agent I have ever dealt with during the last 5 months of my home buying experience. This agent lied to me regarding a structure in the house which was in fact an illegally constructed addition to the original property.
My offer got accepted within a day (surprise!!). But when I raised the issue of providing me with paperwork for the "additional structure", I never heard back from the agent. After countless emails and phone calls, Ms Stoneberger decided that she did not want to go ahead with a buyer who is requesting the necessary paperwork. She apparently had many other offers (????) and was probably hoping some innocent buyer would overlook the "illegal" construction and fall into this mess . I would not recommend Legacy Real Estates to anyone who is looking for a pleasant and professional home buying experience. There are way better choices and professional agents in the area.

I am looking to buy my first house. In order to get a house (SF Bay Area), I'd like to get an FHA loan since I cannot put 20% down. I don't on my own qualify for a house, but my boyfriend is willing to help because after we get married we'll live together in the house. He currently owns a condo- will that automatically disqualify us? How can both of us purchase a home while he owns a condo? He can't sell- bought at mid-price and now is not a good time to sell. We want to rent his condo out- good area, beautiful condo- shouldn't be a problem finding a renter. What do you think? Any suggestions?

How can you figure out the real value of a home?

I am confused about how to formulate a fair bid on a home. Specifically, I am looking at a 3/2 in Fremont, CA. They want $575K. This figure is much higher than the mid-value listed here. Also, its anywhere from 50K to 100K higher than the values zillow posts for homes in that neighborhood. Granted the home I am looking at is in move-in condition, but I can't see paying so much more than the value of the homes around it. Am I correct in looking at it in these terms?

Closing on a new condo tomorrow but worried about addition of satellites without disclosure.

The builder put up 3 satellite dishes on the side of my unit without letting me know. My offer and loan request had already been submitted. The sales office assured me they would look into it, but it's been 10 days, and nothing has been done. Now I don't know if I want to move forward if my unit is going to be the designated satellite area for the whole building. I was thinking of switching to another unit in the building, but those are all sold now. Do I have any legal
recourse if the satellite dishes were not mentioned in my disclosure?

Hi ,

The Rosewood community by Summerhill Homes in Fremont is a very nicely built community.The prices have also come down over the past one year.However, as per the Zillow estimates, all the surrounding properties are almost $200k less than these homes.The questions I have are :

1.Is the difference in prices only due to the age of the homes?

2.If that is the case, would the prices of these new homes be dragged down further as the market move further south?

3.Can a neighborhood have two sets of prices:one for the older homes and the other for the newer ones?

If an existing homeowner from this community is on this forum, can they answer their reasons behind the purchase?

Seems the result I get centers at the specified zip code, but is a much larger region including many neiboring zip code areas. Can I further filter it? Thanks.

Escrow fund release contingency

We had put in an offer on a REO in November and were outbid by another buyer. But, in spite of two extensions on the closing, they could not come up with the funds. So, their contract was canceled and we stepped in with our offer. Our offer has been accepted by the bank and the earnest money deposit is also with the escrow company. The earlier buyer's earnest money however is still in escrow. We have a contingency on that money being released and cannot close before that happens. Here's the exact verbiage for the contingency:

"This contract is subject to Seller providing Buyer with confirmation that funds held in prior escrow(that has been cancelled) have been released from escrow by "2/13/2009".

We got a call from our realtor today saying that the earlier buyer had sent some documents to the title company that indicated that they can now close escrow by the end of next week. This is a concern that we had raised earlier(that the earlier buyer was trying to gather funds) and at that point in time, we were told that since their contract was null and void, there wasn't really much that they could do.

However, at this point in time what the realtor "advises" is to walk away from the property since, purportedly, it will take a long time to be resolved by the bank if it gets to their legal department.

IMO, the realtor has misrepresented the facts to us as we had raised this concern very early in the process and the indication that we got was that this was just procedural. Of course, all of the communication between the realtor and us was verbal.

Any advice on this is appreciated. What we want to know is if the contract is void after 2/13.
