She is the most unprofessional agent I have ever dealt with during the last 5 months of my <a href="http://www.zillow.com/learnmore/what-zillow-offers-buyers.htm">home buying</a> experience. This agent lied to me regarding a structure in the house which was in fact an illegally constructed addition to the original property. <br/>My offer got accepted within a day (surprise!!). But when I raised the issue of providing me with paperwork for the "additional structure", I never heard back from the agent. After countless emails and phone calls, Ms Stoneberger decided that she did not want to go ahead with a buyer who is requesting the necessary paperwork. She apparently had many other offers (????) and was probably hoping some innocent buyer would overlook the "illegal" construction and fall into this mess . But, in spite of two extensions on the closing, they could not come up with the funds. So, their contract was canceled and we stepped in with our offer. Our offer has been accepted by the bank and the earnest money deposit is also with the escrow company. The earlier buyer's earnest money however is still in escrow. We have a contingency on that money being released and cannot close before that happens. Here's the exact verbiage for the contingency:<br/><br/>"This contract is subject to Seller providing Buyer with confirmation that funds held in prior escrow(that has been cancelled) have been released from escrow by "2/13/2009".<br/><br/>We got a call from our <a href="http://www.zillow.com/directory/real-estate-agents/">realtor</a> today saying that the earlier buyer had sent some documents to the title company that indicated that they can now close escrow by the end of next week. This is a concern that we had raised earlier(that the earlier buyer was trying to gather funds) and at that point in time, we were told that since their contract was null and void, there wasn't really much that they could do. <br/><br/>However, at this point in time what the realtor "advises" is to walk away from the property since, purportedly, it will take a long time to be resolved by the bank if it gets to their legal department.<br/><br/>IMO, the realtor has misrepresented the facts to us as we had raised this concern very early in the process and the indication that we got was that this was just procedural. Of course, all of the communication between the realtor and us was verbal.<br/><br/>Any advice on this is appreciated.
