Wisconsin law only requires landords, which i will be, to give 28 days notice. Do i have to honor the clause?<br/>Also, if this clause is not legal, does it make the contract void? The sellers disclosure reported nothing wrong with the home (duplex) except a small crack in the basement which didn't leak. <br/>We just went through a home inspection. Listed are the main things that we wanted remediated. There were more cracks on the outside (I didn't notice them) and the basement definitely leaks (thank goodness it rained the day before), the water heaters are both past useful life (15 yrs) and one of them shows corrosion at the pipes connecting to it, and the furnaces are at or near useful life (20 and 25 yrs). Roof Sheathing needs replacement, mold in attic, one of the rooms doesn't get heat, crack in garage slab turned out to be worse than we thought.<br/>We gave notice of defects (we gave them right to cure), the sellers agent told my agent verbally that the sellers will not fix anything but mold. We tried writing a mutual release so we could move on (otherwise they have ten days technically from the notice to respond, which they are using all of) but the sellers want to keep our earnest money claiming we didn't list actual "defects". We did a last ditch effort of asking for a 5k credit instead of fixing the furnace and water heater issues to no avail.<br/><br/>Wouldn't these things be defects since they definately affect the value of the home?
