We have been waiting on our lender, BoA, for nearly 3-months to fund the loan. We were 5 days from closing and the seller threatened to cancel the sale unless we remove all contingencies. We removed contingencies and the next day, the seller gave escrow a notice to cancel. We are now 3 days form closing and our agent advised us that the seller (a licensed real estate agent), is attempting to swindle us out of our deposit and to relist the property. He advised us to prepare to go to court (file a lis pendens) over this as we are ready, willing, and able buyers (as evidenced by us fully funding our portion of escrow).

Please recommend a real estate attorney in the los angeles area to assist us. Also, do not use BoA for your real estate needs.

"After months of looking at homes and being outbid at least 15 times, first-time home buyers Lance Thorson, middle, and Kelli Thorson, right, with 2-year-old daughter Mia, are now making offers on houses before they even see them."

PHOENIX - Each time Lance and Kelli Thorson thought they had found their first home, someone would outbid them. It's already happened at least 15 times.
This wasn't how it was supposed to be in a depressed housing market like Phoenix. Buyers are supposed to be able to walk in, and get pretty much whatever they want. Now, the Thorsons have taken up a tactic not seen since the heydays of the housing bubble — they are making offers on homes before they've seen them, as many as three per day.
"It's frustrating because we've jumped through all the hoops and there still isn't a reward," Kelli Thorson said.
In Phoenix suburbs and other areas of the nation saturated with foreclosed homes, low prices for bank-owned properties are sparking bidding wars that drive up sale prices, entice investors and frustrate traditional buyers who make dozens of offers and still can't land a home.
Experts say the environment is strikingly similar to what they saw at the height of the real estate bubble.

July 15 (Bloomberg) -- Russian millionaires are returning to the U.S. property market, lured by distressed sales and the ruble's rise against the dollar, lawyer Edward Mermelstein said.
"The way many look at the U.S. right now is that it's a bargain," said Mermelstein, who has arranged about 300 real estate deals for buyers from the former Soviet Union since 2007.
Mermelstein, 41, closed two purchases and bid for 20 more residential and commercial properties in New York and Miami for Russian and central Asia clients in the past three months, he said. That compares with no deals or offers in January, he said.
Manhattan apartment prices dropped for the first time since 2002 in the second quarter as the collapse of Lehman Brothers Holdings Inc. and Bear Stearns Cos. caught up to property owners in the nation's most expensive urban market. The ruble rallied about 13 percent against the dollar from this year's low on Feb. 17 and 4 percent against the pound sterling from a Feb. 6 low.
U.S. sellers are cutting prices 30 percent to 40 percent from their peak in 2007, Mermelstein said in an interview in Moscow, where his firm has an office.
"All of a sudden in the last three months activity's picked up," he said.

making an offer on a short sale property

When making an offer on a short sale property, is it wise to offer bellow the asking price? Not sure how they (short sales) work. Do the sellers have to stick to the asking price? The property I'm interested in has been on the market as a short sale for over 4 months.
