I know short sales take months and months and months. And I also recognize there are extra costs associated with short sales such as paying my buyer's agent's commission usually. (along with a million other things.)<br/><br/>Some things were crossed off on the addendum and it was written that the sellers would stay in the home 30 days after closing. This seems unacceptable to me for obvious reasons. It doesn't seem to me that a short sale seller would have much motivation to actually leave.<br/><br/><strong>Would I be able to require the property be vacant at closing and do a final walk-through to ensure this?</strong> Could I also change the locks at that time? I would put a stiff penalty for violations like $250 a day or so. I have ZERO interest in collecting rent that probably wouldn't be paid anyways.<br/><br/>Is this legal for Ohio? I would not want to have to deal with an eviction headache.<br/><br/>Also, is the date of closing the day that you sign the papers or the day that they are processed? I'll try to summarize. The seller and us initially accepted an offer for the home we're hoping to buy. We paid for a home inspection and he discovered the serial #s of the furnace and AC showed a different date than what was described on the seller's real estate description. Their description said the AC was installed in 2012 (the serial proved it was manufactured in 2007), and worse yet they said the furnace was less than 10yrs old - putting the install date at 2005 oldest case scenario (the serial proved it was manufactured in 1998). I will note, however, that the inspector said it looked to be in good working order.<br/><br/>I've done my research, and I'm well aware of the variables and things that can affect the life span of the two most expensive electrical appliances in your home. With that being said, most experts say the life expectancy of a furnace is on average between 15-20yrs... and 10-20yrs for an AC.<br/><br/>I'm not as concerned with the AC being 8yrs old, but... the furnace is 17yrs old. So that puts the furnace on its last leg (3-8yrs left at best?), and even the AC is basically halfway through its life. Not only did the seller/her realtor lie or give misleading information or just fail to look into this to retrieve the correct info, but replacing a furnace 3yrs into buying a home is a lot different than being able to wait and plan for that expense 10yrs later. The base cost is $150,000 and we would add nearly $25,000 in optional additions (Morning Room, Deck, etc) and this would bring our monthly mortgage payment to around $1,200/month (which is very similar to our current much smaller apartment's rent).
