After reading the article, I understand that a loan is taken out (until the taxes get ammended and you actually get the refund), but where do you apply for this loan? And if closing costs and buying down of rates don't equal 8k, do you still get whatever is excess to keep?

You still need a down payment of 3.5% minimum for FHA available without the credit. You can read more about getting the credit upfront to help pay closing costs here. This FAQ about the tax credit is also very helpful here and has lots of good information about who qualifies, how to apply etc. Hope the links help.
