I would not count on that clause to protect me if I were you. <br/><br/>Also the landlord may get the bright idea to try to find a new tenant to lease during the holidays and use your lease as a reason not to try very hard. Come spring, they may list it for sale, but that won't protect you from a judgement. <br/><br/>Don't take the chance. Ask for the written release and/or at least get their intention to sell instead of re-rent in writing to protect yourself. Check with an attorney to be sure. When I sold, I had tenants. I made sure to give proper legal notice for showings and they stayed through the escrow period. I treated them with consideration and asked for a convenient block period for showings twice a week<br/><br/>I made arrangements for an open house in the first 2 weeks of the listing and offered them a cash bonus back if the house went into escrow within the first 60 days so that they had a "buy in" to keep the place nice for showings. Although my contract did not require it, I also gave them another $200 toward moving. Sale went off without a hitch.
