Think of it as an unplanned update.<br/><br/>If the termite company offers you a continuing treatment plan with follow up inspections, I would seriously think about signing up for the next year or so to cover your bases. Termites are often not killed on the first treatment or even two especially if they are in more than one area. Making sure that you get them all and resolve the source of the problem like water, excess ground moisture etc before you let that company walk away is an worthwhile investment. Sun, 03 Apr 2011 19:33:00 GMT http://www.zillow.com/advice-thread/Found-termites-after-buying-and-after-inspection-can-we-do-anything/393264/ 2011-04-03T19:33:00Z This is a tough situation, ... http://www.zillow.com/advice-thread/Found-termites-after-buying-and-after-inspection-can-we-do-anything/393264/ This is a tough situation, without looking at any/all contracts you've signed regarding the termite inspections, it's rough to say exactly what recourse(s) you might have.&nbsp; Let me try to handle the problems one point at a time, starting backwards:<br/><br/>-&nbsp; Yes, you can complain about the Realtor(s).&nbsp; Depending on what you have in writing (in response to the termite problem) you might have legal grounds to pursue action against them, although that is unlikely, costly, and a long shot at best.&nbsp; What I would do is gather the documentation you have and report it to their broker.&nbsp; If the doesn't get any traction, report to the real estate licensing entity in your state and file a formal complaint.&nbsp; All that being said, if you have nothing documenting their stance on the Termite problem being downplayed, I would not bother.&nbsp; It would be your word against theirs, and in the end that will just waste your time.<br/><br/>- Can you sue the Termite company?&nbsp; Can you get a refund?&nbsp; If termites are present after a treatment, then yes, you have an affirmative course of action against the company.&nbsp; The only exception to this would be for them to prove the termite infestation you now face is a completely separate, second infestation.&nbsp; That isn't likely assuming this is a short time period we're talking about here - I'm assuming that.<br/><br/>Again, check your paperwork.&nbsp; What did you sign?&nbsp; What receipts and documentation did they provide you with?&nbsp; Does the company even have a good reputation?&nbsp; <br/><br/>Call the termite company and inform them the house is still infested - use that word, "Infested".&nbsp; They should respond with a secondary treatment at no cost.<br/><br/>If you do not possess a copy of any of the official paperwork, ask the termite company for it.&nbsp; At this point, examine your options.&nbsp; Do they guarantee results?&nbsp; <br/><br/>Worst case, report them to the better business bureau, formally file a complaint for lack of services performed with your attorney general, and cut your losses.&nbsp; Find a reputable, experienced and guaranteed pest control service and get them to take care of the problem before it gets out of control.<br/><br/>In the future, do not rush to buy a home.&nbsp; Don't buy a home with Termites in it (ever, under any circumstances - get it treated and verified clean first) and make sure you keep signed copies of EVERYTHING provided to you, ever.&nbsp; This includes correspondence between all parties, even casual emails with your Realtor. I bought a house and after living in the house for about a year I found the termites eating my books and the wooden window frames in the basement had been eaten by termites and all I found was soil in the wood. I suspect the seller&nbsp;&nbsp;hid knowledge of a defect in the property, &nbsp;and they knew of the termite problem but the termite inspector in their report did not disclose this termite problem as the inspection was done while the seller lived in the house and covered the termite problem. I'm not sure, kind of a weird situation with not a lot of precedents to go against. We've had the house treated multiple times, and documented everything. Even after changing out the baseboards and spraying inside and out, we almost installed gutters to keep moisture away from the ground. We've spent over $2000 to help with this situation, very frustrating. We just received a letter from the company saying it would be another $100 to extend the year warranty which I think they should do for free. Not even sure they know what they are doing anymore and I hate having this many chemicals pumped into the house, especially with pets. If the amount is substantial they'll run it through their insurance.
