The water company may not have a problem sharing the easement, but the neighbor might. Own the contract. Get one in first to show you are serious but make it all contingent on your biggest issue - the property line. Think a little outside the box on this one...you could also make it contingent on the current owners replacing the fence in it's proper place and moving the shed and digging up concrete. It's not a big deal to them now because no one has mentioned anything but it could cause litigation problems for you in the future if you don't cover your basis. I would not buy it as is unless you are prepared for future problems. 16 feet is alot of yard! I hope this helps!!
