So it would appear that the poster does not owe the buyer agent or the broker of the buyer agent a dime. The poster needs to inform the Listin g agent in writing that the home did not pass inspection contingency and the buyer will not proceed with the transaction. <br/><br/>Note:<br/>Buyer agent is not defined. During the Due Diligence period, the Buyer can walk for a reason or no reason. You would only incur the expenses such as inspections and/or appraisals that you ordered. The Buyer's Agent cannot collect unless you have agreed to an up-front fee which would normally be credited back to you at closing. You should take a moment and write to the Agent's Broker--In-Charge and request that you be released from the Agency Agreement and hopefully you will find a more credible and compassionate Agent. You are the buyer and the standard is the&nbsp;seller is the one who pays out the commissions that are negotiated by the listing agent which usually are 3% percent to whomever ever finds the buyer and 3% to listing agent. <br/><br/>Fire her and look for someone who will work in your best interest. You can asked to be released rom the agreement and simply tell them you are going a different direction. The buyers agency agreement usually covers the agent from you firing them and then going back and buying a home he/she has shown you. In that instance you would most likely owe that agent the commission.
