It is negociable.  Talk with your agent, explain the situation, and insure that you get a release with the contigencies spelled out with in the release.  You might be asked for some compensation...  however, hopefully your agent will be understanding to allow you to cancel the listing agreement with no compensation.   Another contigency that might be spelled out is that you can not SELL your home for the duration of the original listing agreement to any buyer that your property was shown to by the agency. Take the time to read your listing agreement...  you should find something in regards to your question with in the listing agreement...   I know our listing agreements do...  Have you considered asking the agency representing you to help you rent your home?  The agency can help with that....  You might also want to consider leaving your home on the market and on the rental market with the agency that is currently representing you.... and take the first, either a buyer interested in your property or a tenant interested in renting your property....  All in all....  contact the agent (or the broker in charge)....  there are other options in which they can explain to you....  Hope I have helped a little in answering your question.  And good luck .

Dear Sellbysell,I never believed in gambling... though sometimes...  I guess waiting could be the best thing, however... it could also NOT be...  With the IRS First time home buyer's stimulus plan and other stimulus plans out there... ect...I guess you first need to ask your self...  Why am I asking this question... to refinance, or to purchase a new home... then ask yourself why are your refinancing or looking to purchase a home....  Then ask your self... will the payment be in the range in which I need it to be..... You are taking a risk wishing that it will fall below 5%...  And the economy today....  is risky at best...

I would recommend that you lock....  unless you are a gambler...  though keep in mind... gambling can sometimes lead to loses...

FHA loan denied!

wow....... I have been reading alot of the responses after my response to you..I beg you to call another lender...  FHA may NOT be the route that you will be able to go through... however there are several conventional loans....    ect...  Please contact a knowledgable real estate agent with in your are....and talk with lenders/banks...  I would also remmmend being prepared... go to www.equifax.com. or any other credit report site... and purchase the TRI-preport....  so you know UPFRONT any issues you might have to clear before making an offer on a property...

I disagree with VIctoria Wells, comment as to giving and extra 90 days....    Either you want to sell... or you don't...  times are tough...  and as she stated... the listing company has already most likely spent money.... to advertize your property.....  However... consider this..... IS YOUR PROPERTY SALEABLE... AND PRICE RIGHT TO SELL , in todays market and your area's market.......because I am NOT an agent in that area............ I am sorry..........  I couldn't tell you that.......However, I still highly recommend that you contact a knowable agent ("REALTOR") with in your area to help list and sale your property and/or find you a property.... as they will be more knowlegable as to the Federal law and State Laws that will apply to both the seller and/or the agent for that area..  that is the BEST advise I can give you... other than to hirer and attorney............

I highly recommend that you contact a knowable agent ("REALTOR") with in your area to help list and sale your property and/or find you a property.... as they will be more knowlegable as to the Federal law and State Laws that will apply to both the seller and/or the agent for that area..  I would also recommend an appraisal as well...

I highly recommend that you contact a knowable agent ("REALTOR") with in your area to help list and sale your property and/or find you a property.... as they will be more knowlegable as to the Federal law and State Laws that will apply to both the seller and/or the agent for that area..  and if that doesn't satisfiy you..  I would recomment an appraisal..though you can go to your assessors offices as will and get the details...............  howevr... REAL ESTATE agents (NAR AGENTS)...  are most likely to understand and get that information to you as well..I would recommend that you interview agencies and agnent...  and I would recommend that you demand a CMA report of the most recent sales and current listings EVERY 30 days...

My appraisal seems much lower than comparables in my neighborhood. How do I correct this?
