Hi Zack,I'm so sorry you in this predicament. If the seller cannot produce the remaining funds need to satisfy the mortgage by the deadline you have few options: 1.) Seller can contact lender for loan modification or short sale if they are in financial hardship (not a quick decision) or 2.) You can increase your sale price- not your first choice I'm sure You will get your earnest money deposit back and the inspection, appraisal and rate lock fees would need to go through small claims court I believe. However, if they have no money that might be difficult to get compensated in a timely fashion. Hopefully you or the seller has an experienced agent that can assist with keeping this together.
