I would strongly suggest you go to the government agency that issues the building permit for the property in question and make sure you know what will be required to issue one.  That way you minimize the possibility of a big surprise.Best of luck Bruce

where do I get a sellers disclosure form

What ever disclosure form you use make sure it meets the minimum requirements as set by the state of Texas.  Also be sure to take it seriously because it is your first line of defense if the buyer decides there is something wrong with the house and they want to hold you responsible.Bruce

My siblings and I are trying to sell my parents house.

It is possible a title company will do it but they will probably want an affidavit of airship signed by someone who knew both your parents but who is not you or anyone who will benefit from the sale.  You will have to search to find a title company who will do it because some will not.  Depending on you parents marriage history and if there are any children from other relationships it can get rather messy and confusing so patients and time are needed. If your buyer is an experienced investor they probably have a title company you can use and will be willing to wait until the title is clear to close.Just one word of caution .. make sure the price is agreed to upfront by everyone who has to sign on the closing papers.  I worked on a deal like this for over 6 months and right before we were ready to close one of the kids changed their mind and would not sign unless the price was higher. The deal fell through and the investor buyer ended up picking up the property through a back tax auction and none of the kids got a dime.Best of luck .. Bruce

I have way to many questions to even start answering your questions. If you do not trust your agent then ask for their manager / broker to sit down with you to go over everything in the contract.  If the manager or broker will not talk to you in an honest way then maybe a real estate attorney is called for. If you have the right contract and it was filled out correctly then a lot of your questions and issues will be answered.Best of luck Bruce

My realtor filled in the bid with FHA loan but we are approved for a USDA loan.

If you are using the standard TREC contract, the One to Four Residential Contract and you have a Termination Period Paragraph 23 and are still within its time period .. then now is the time to negotiate different terms with the Seller.  If the Seller says no then it is a lot cleaner and easier to terminate the contract and get your Earnest Money back.  Putting the negotiate off just can just make the Seller mad and make them want to fight for the Earnest Money and that is never fun.Who knows maybe the Seller will be ok with the change and everything will work out in the end.  But I strongly suggest you be a stronger advocate for your wants with your agent and double check everything they do from now on.Best of Luck ..
