If you can work something out with them, it would be fantastic.  Consider the costs you may not have in selling to them, compared to the costs you may incur in selling to someone else.  Also consider the expenses you may incur in working to get top dollar compared to what that price may be compared to what you are offering them.  Lots to consider here.  Based on what you said, it seems you may have offered them perks in taking a deal.  Not sure what the GR market is, but in SE Michigan the sellers are in complete control.  I trust you have a good agent who can help you weight all of this out...

You don't need an attorney to go to court ... but I surely would not recommend going it alone.  Same with buying a house...

closing with immediate occupancy

Sorry to hear about this situation.  Yes, it sounds like someone, somewhere may not have thought this all the way through.  When I represent a seller, I ALWAYS make sure they have plenty of time.  Even when they say they don't need it, it is funny how often it actually gets used.To that end, it really depends on how your contract reads surrounding this as it *should* have verbiage in there that states what happens in a case like this.I am not an attorney, so I am not and do not give legal advice.  This is my real estate opinion, but you need to consult with your agent and possibly your attorney...1.  You might opt to allow the post-closing occupancy and possibly for a sum that covers whatever your expenses would be ... at a minimum ... and possibly more?  It sounds like you are in the driver seat on this one.2.  You might opt to wait to close until the house is vacated ... but it sounds like this has to close for the other chain of events to happen, so possibly not an option.3.  IF you allow for the post-closing occupancy to occur, I recommend it being very clearly spelled-out in-writing.Good luck and please keep us posted.

You need to align yourself with a local expert who can help you wade through those processes to see if it is an option.  Have you spoken to a loan officer?  Can you purchase the home without selling your current home?  These are two of MANY questions that would need to be answered to determine that.We would be happy to speak with you about it further to help you navigate through.

Home Purchase? Size Dilemma

Obviously you are very intelligent, wise, successful buyers who I trust have done spreadsheets, etc. to get this all figured out.  I would have, too  :-)That said, make sure your spreadsheet has a column about enjoyment and quality of life as at the end of the day it is where you live, make memories, etc.  Of course the financial component is important ... but in this case I think it would take a backseat to getting the house that best suites wants, needs, lifestyle, etc. ... if it were me, anyway.If I were you, I would not get hung-up on the price per SFT, for instance, if the house completely fits the bill for everything else ... especially if it does even moreso than the larger home.You will make the right decision for you.  Enjoy the new home!

I need to get an estimate on my home...

I have never understood how someone can give an estimated value of a property without seeing it.  I've walked into palaces, and barnyards.  That obviously plays a role in value beyond just # of BRs, BAs, etc.  Pricing and getting top dollar for a home goes well beyond *price per SFT*, etc.  Only until I see a property can I estimate it's value.If you called your Doctor and said, "I have a cough ... what is wrong with me?" they are probably going to want to see you before making a diagnosis, right? So, I recommend you interview some top agents in your/our area and decide for yourself who the best fit is with the best approach.Hope that helps.

It would have been best to have dealt with all of this in a purchase agreement and know what you are getting into ... before you get into it.  I'd quickly get familiar with the lease that is in-place, and the Michigan Landlord Tenant Act if I were you...
