Section 1 Condition of Premises and Assessment of Damages
Return of Premises.
At the conclusion of the Lease Term, the Tenant shall return the Premises, including all fixtures, furnishings, and appliances provided by the Landlord, in substantially the same condition as at the commencement of the Lease, reasonable wear and tear excepted.
Inspection.
Within 14 days prior to the end of the Lease Term, the Landlord and Tenant shall conduct a joint inspection of the Premises. The purpose of this inspection is to identify any damages or deficiencies beyond normal wear and tear.
Assessment of Damages.
Any damages, repairs, or replacements required due to negligence, misuse, or neglect by the Tenant (or Tenant's guests) shall be documented in writing and supported by photographs and/or contractor estimates where applicable.
The cost of such damages shall be deducted from the Tenant's security deposit. If the cost exceeds the amount of the deposit, the Tenant shall remain liable for the balance, payable within [number] days of receipt of written notice from the Landlord.
Normal Wear and Tear.
Normal wear and tear refers to deterioration that occurs in the ordinary use of the Premises without negligence, carelessness, accident, or abuse. Examples include minor scuffing of paint, small nail holes from hanging pictures, or carpet wear from normal foot traffic.
Final Accounting.
Within 30 days following the end of the Lease Term and the Tenant's vacating of the Premises, the Landlord shall provide the Tenant with a written itemized statement of any deductions made from the security deposit, along with any balance due to either party.
Abandonment of Property.
Any personal property left behind after the Tenant vacates shall be considered abandoned after 30 days, and the Landlord may dispose of it in accordance with applicable law.
No Smoking Policy.
Smoking, vaping, or the use of any tobacco, nicotine, or marijuana products (including electronic cigarettes) is strictly prohibited inside the Premises, including all interior spaces such as bedrooms, bathrooms, hallways, garages, and enclosed patios.
Section 2 Lease Term
Duration.
This Lease Agreement shall commence on [TBD Start Date] and shall continue in full force and effect for a fixed period of twelve (12) consecutive months, ending on [ TBD End Date], unless earlier terminated in accordance with the terms of this Agreement.
Renewal.
At least thirty (30) days prior to the expiration of the Lease Term, either party may provide written notice of their intent to renew or terminate the lease. Renewal, if agreed upon, shall be subject to mutually negotiated terms, including rent and duration.
Holdover Tenancy.
If the Tenant remains in possession of the Premises after the expiration of the Lease Term without a written renewal, such occupancy shall convert to a month-to-month tenancy under the same terms and conditions of this Agreement, except that rent may be adjusted at the Landlord's discretion upon thirty (30) days' written notice.
Section 3 Maintenance and Repairs
Landlord's Responsibilities.
The Landlord shall be responsible for the maintenance, repair, and upkeep of the Premises, including but not limited to structural components, plumbing, heating, electrical systems, appliances provided by the Landlord, and exterior areas such as the roof, lawn, and landscaping. All maintenance shall be performed in a timely and workmanlike manner consistent with applicable laws and housing codes.
Tenant's Responsibilities.
The Tenant shall keep the Premises clean, sanitary, and in good condition and shall use all fixtures and appliances in a reasonable manner. The Tenant shall promptly notify the Landlord of any condition requiring repair or maintenance. Failure to do so may result in the Tenant being held liable for additional damage resulting from delayed reporting.
Unauthorized Repairs.
The Tenant shall not make or authorize any repairs, alterations, or improvements to the Premises without prior written consent from the Landlord. Any unauthorized repairs or modifications may be restored at the Tenant's expense.
