ACKNOWLEDGEMENTS: Lessee acknowledges that the premises are in good condition and acceptable in conjunction with the terms of this agreement. Lessee also agrees to: (Initial in space)
- Maintain the premises in the same manner and condition as that of the effective date of this agreement;
- To make no alterations, additions, or installations to such dwelling, such as to reconstruct, remodel, paint, wallpaper, change locks, use screws, large nails, or fastening devices, or adhesive materials, place signs, displays, or other exhibits on/in any part or parts of premises without the owner's advance written approval;
- To obey all laws/ordinances affecting such premises (to include noise abatement, lawn care (lawn service available), trash laws, occupancy regulations, no smoking, etc.).
- To repair or replace all broken or cracked glass on such premises.
- To pay the cost of all repairs made necessary by the negligent or careless use of said premises either by Lessee, guests, or third parties while on premises.
- To maintain personal liability insurance for said premises, and release Lessor from all liability for any damage resulting to persons or property while on premises stated herein.
- To clean premises, including stove and oven, refrigerator, sinks, tub and shower and flooring and to leave apartment in the same condition with which it was received or to pay for such cleaning.
- To remove all trash from apartment to waste receptacle located in the alley and to not leave trash bags in garage or apartment. Lessee shall be responsible for disposing of items of such size and nature as are not normally acceptable by the garbage hauler.
- To be responsible for interior management of pest control.
OCCUPANTS: Lessee shall not allow anyone to share said premises, keep roomers or boarders, nor sublet any part of the premises without Lessor's written consent. Anyone staying for over 10 days/month shall be considered a breach of contract. If primary lessee vacates the premises all occupants must vacate the premises. If said premises will be occupied by persons under 18 years of age they will be listed on agreement.
UTILITIES: Lessee is responsible for the full amount of the electric utility. The Lessee is responsible for all utilities and/or services based upon occupancy except trash/recycling. Lessor is not responsible for snow/ice/leaf removal.
RIGHT OF ENTRY: Lessor shall have the right to enter, inspect, and/or repair the premises at any time in case of an emergency to examine or exhibit the premises, and within the period of 45 days prior to the termination of tenancy, to show the premises to prospective tenants, buyers, lenders, and maintenance with advance notice to Lessee.
LIABILITY: Lessee shall pay (a) for any expenses, damage or repair caused by the stoppage of waste pipes or overflow from bathtubs, wash basins or sinks, and (b) for damage to windowpanes, drapes, carpeting, curtain rods, light fixtures or other damage to the interior of the premises. Lessee is responsible for any common maintenance or repairs that cost less than $50 including, but not limited to light bulbs, air filters, and blinds. Lessee shall use catch-drains for hair removal and not use Drano or any other caustic drain cleaner without prior notification of Lessor. Lessee can use the fireplace and is responsible for any damage to person or property involved with fireplace use. Lessee is responsible for all reasonable attorney fees and costs if any legal action or proceedings be brought by either party of the agreement.
PETS: No animal, fowl, fish, reptile, and/or pet of any kind shall be kept on or about the premises, for any amount of time. Unauthorized pets will immediately void contract if found to be in violation hereof.
LIQUID: No liquid-filled furniture or receptacle containing more than ten gallons of liquid is permitted without prior written consent and meeting the requirements of the Lessor. Lessee also agrees to carry insurance deemed appropriate by Lessor to cover possible losses that may be cause by such items. The Lessee is to report ANY water damage of ANY KIND immediately. Lessee will be responsible for any repair costs for water damage deemed by Lessor to be exacerbated by neglect.
PARKING: The Lessee has a two-car garage for parking. Street parking is available for over-flow if needed in front of the condo.
NOISE: Lessee agrees not to cause or allow any noise or activity on the premises which might disturb the peace and quiet of another Lessee and/or neighbor. Noise levels should be limited from 10PM-7AM. Said noise and/or activity shall be a breach of this agreement.
DESTRUCTION OF PREMISES: IF the premises become totally or partially destroyed during the term of this agreement so that Lessee's use is seriously impaired, Lessor may terminate this agreement immediately upon three-day written notice to Lessee.
HOUSE RULES: Lessee shall comply with all house rules as stated on separate addendum, but which are deemed part of this rental agreement, and a violation of any of the house rules is considered a breach of this agreement.
TERMINATION: Any failure on the part of Lessee to pay rent, or any part thereof, or to comply with any of the terms of this agreement, shall, at the election of the Lessor, terminate this tenancy agreement and all rights of Lessee hereunder. Termination action will be communicated via a termination notice and based on the specific situation, will state the effectivity of the termination from 3-30 days notice.
POSSESSION: Upon termination of the tenancy, within two weeks, Lessor may reenter the premises and remove any and all persons and property there from and reposes said premises. Lessee hereby waives all rights to any notice from Lessor of his election to terminate the tenancy, or any demand for the payment of rent or for the possession of the premises.
INSURANCE: Lessee acknowledges that Lessor's insurance does not cover personal property damage caused by fire, theft, rain, war, acts of God, acts of others, and/or any other causes, nor shall Lessor be held liable for such losses. Lessee is hereby advised to obtain his own insurance policy to cover any personal losses. Renters insurance is not required, yet recommended.
WAIVER: Waiver by Lessor of any breach of any term or condition of this agreement shall not constitute a waiver of subsequent breaches.
PARTIALLY INVALIDITY: If any part of this agreement shall be in conflict with the law that part shall be void to the extent that it is in conflict but shall not invalidate the agreement nor shall it affect the validity or enforceability of any other provisions of the agreement.
