1. Term of Stay Check-in: 3:00 PM // Check-out: 11:00 AM.
Minimum stay: 30 nights
Monthly Rent: $1,600 per month due on the 1st of each month
Late Fee: $25 per day after the 3rd day past due
2. Payment Terms--
Security Deposit: $1600 (refundable within 7 days after checkout, pending inspection)
Cleaning Fee: $125 (non-refundable, will be taken from security deposit)
Electricity: Rent includes up to $100/month in electric usage; any overage will be billed to the guest, taken from security deposit.
Payment Schedule: - $1600 deposit due at booking (to reserve & block dates on the calendar) - Remaining balance due 30 days prior to check-in
3. Included Amenities & Services
The following utilities are included with rent: water, internet, trash service, and HOA fees. Guest will enjoy full access to the resort amenities, which include: two heated pools, beach access, boat slips (first come, first served; rental arrangements handled through the Kokomo Yacht Club), dock fishing with underwater green lighting, fish cleaning station, conference rooms, clubhouse (open 9 AM 6 PM; after-hours rental available through the Kokomo Yacht Club), pickleball court, fitness center, and outdoor BBQ grills. The condominium also features an in-unit washer and dryer, dual HVAC wall units, and complimentary on-site parking (uncovered and unassigned).
4. House Rules - No pets allowed (per HOA regulations) - No smoking inside the unit - Maximum occupancy: 5 guests - Quiet hours: 10 PM 8 AM - Guest agrees to follow all HOA and resort rules posted on-site
5. Cancellations - Full refund if canceled 60+ days before check-in - 50% refund if canceled 30 59 days before check-in - No refund if canceled within 30 days of check-in (unless the unit is rebooked)
6. Liability & Damages -- Guest is responsible for any damage to the property, furnishings, or contents that exceeds normal wear and tear during the stay. Owner shall not be held liable for any accidents, injuries, or loss of personal property that occur on or within the premises. Guest agrees to reimburse Owner for the full cost of repair or replacement for any damage, loss, or missing items discovered during or after the rental period.
7. Check-Out -- Guest must leave the unit in tidy condition: dishes washed, trash removed, and linens placed in the laundry area. Inventory of items inside the condo will be checked; any missing or damaged items will be charged at replacement cost. Any excessive cleaning or damage will be deducted from the security deposit. Guest must notify the Owner promptly of any breakage or damage during the stay.
8. Governing Law -- This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, with venue in Nueces County.
9. Right of Entry -- Owner or Owner's representative may enter the property with at least 24 hours' notice for inspection, maintenance, or in case of emergency.
10. Early Termination -- Owner reserves the right to terminate this Agreement and require immediate vacancy if Guest violates HOA rules, house rules, or engages in unlawful activity.
11. Assignment & Subletting -- Guest shall not assign, sublet, or permit the property to be occupied by anyone other than those listed on this Agreement without prior written consent of Owner.
12. Emergency Contact Guest shall provide an emergency contact name and phone number prior to check-in.
