This Lease Agreement is expressly contingent upon the issuance of a valid Occupancy Permit by Scott Township for the leased premises. The Landlord shall be solely responsible for applying for and obtaining the Occupancy Permit prior to Tenant's possession of the premises. Tenant shall not take possession of the premises until such permit has been obtained. In the event that Scott Township does not issue the Occupancy Permit on or before the scheduled commencement date of this Lease, the commencement date shall be automatically extended to the date on which the Occupancy Permit is issued, without penalty to either party. If the Occupancy Permit is denied and cannot be obtained within thirty (30) days after the scheduled commencement date, either party may terminate this Lease upon written notice, and any amounts paid by Tenant in advance shall be promptly refunded. Tenant agrees that Landlord shall not be liable for any damages, costs, or expenses incurred by Tenant as a result of delays in issuance of the Occupancy Permit.
