Nature of Agreement This is a short-term, seasonal occupancy agreement for temporary, recreational use only. It is not a residential tenancy under Florida's Landlord-Tenant Act (Chapter 83). Lessee acknowledges they are a guest/licensee, not a tenant, and have no tenancy rights beyond the term of this agreement. 2. Payment Terms Entire rent for the agreed term is due in full and in advance before occupancy. Security deposit is due at the same time as rent payment. All rent and deposits are non-refundable once paid, except in cases of Lessor's breach. 3. Security Deposit Applied toward damages, missing property, excessive cleaning, or breach of agreement. Refundable within 14 days of departure, minus deductions. 4. Occupancy & Guests Only the two named guests on this agreement may occupy the property. No overnight visitors without written approval from Lessor. Subletting, sharing, or transferring this agreement is prohibited. 5. Utilities & Maintenance Included utilities: water, electricity, trash service, high-speed Wi-Fi, and basic cable (if available). No cap on normal usage, but excessive or negligent usage may be billed separately. HOA provides exterior and grounds maintenance. Lessee is responsible for keeping the interior clean and promptly reporting damage. 6. Furnishings & Inventory Property is fully furnished with an inventory list provided at check-in. Lessee is responsible for loss or damage beyond normal wear and tear. 7. Quiet Hours & Conduct Quiet hours are 9:00 PM to 9:00 AM daily. No loud music, parties, or disruptive behavior at any time. Any illegal activity, nuisance, harassment, or repeated disturbances are grounds for immediate termination without refund. 8. Termination by Lessor Lessor may terminate this agreement at any time for: Violation of maximum occupancy Unauthorized guests Illegal activity Excessive noise or disturbance HOA rule violations Any conduct deemed unsafe, damaging, or disruptive to neighbors or property Upon termination, Lessee must vacate within 24 hours. All prepaid rent is forfeited. 9. Early Termination by Lessee Lessee may terminate before end of term, but no refunds of prepaid rent will be given. 10. Entry & Inspection Lessor may enter the property with 4 hours' notice for inspections, repairs, or to address rule violations. In emergencies, Lessor may enter without notice. 11. Liability & Insurance Lessee's personal property is not insured by Lessor. Lessee is encouraged to obtain renters/travel insurance. Lessor is not responsible for accidents, injuries, or loss of personal belongings. 12. HOA Rules Lessee agrees to follow all HOA rules provided. Violation of HOA rules is grounds for immediate termination without refund. This Rider forms part of the Snowbird Lease Agreement for 301 Lullwater #277. Panama City Beach, FL]. In the event of any conflict between the Lease and this Rider, the Rider controls. Short-Term Nature This agreement is for a temporary stay only. It is not a leasehold or tenancy, and Florida landlord-tenant protections for residential leases do not apply. Immediate Removal Lessor reserves the right to terminate and remove Lessee immediately (with or without refund) for: Breaking maximum occupancy Hosting unauthorized visitors Excessive complaints from neighbors or HOA Illegal conduct Damage or misuse of property Any behavior Lessor deems threatening to the safety, comfort, or reputation of the property/community No Right to Cure Violations of sections 4, 7, 8, or HOA rules result in immediate termination without notice or refund. Non-Refundable Rent is prepaid, non-refundable, and not prorated for early departure, eviction, or shortened stays. Waiver of Claims Lessee waives claims against Lessor for emotional distress, relocation costs, or consequential damages in the event of termination. Legal Venue Any disputes are resolved in Bay County, Florida. Lessee agrees to reimburse Lessor for reasonable legal fees if Lessor prevails in enforcing this agreement.
